What to Document Before Backfilling a New Foundation
Use a jurisdiction-aware release record to document inspections, waterproofing, drainage, cure, protection and responsibility before soil hides a new foundation.
The short answer
Before backfill, record the actual jurisdiction and permit, required inspection or hold point, approved foundation detail, installed products, cure and weather conditions, protection-course compatibility, footing-drain discharge, visible defects, photos, backfill plan and named responsible people. This is a United States homeowner workflow for the foundation-to-backfill handoff. It assumes a builder coordinates the work and the homeowner keeps a durable project record. It does not identify your city, county, state, tribal or other authority having jurisdiction because the project location was not supplied. The actual AHJ’s adopted code, permit conditions and inspection list control local requirements. A photo, text message or remote opinion is not a substitute for an AHJ inspection or a licensed professional’s site decision unless that authority explicitly says it is.
Before backfill, release the soil-hiding work only when the record is complete enough for the next decision #
The homeowner should release foundation backfill only when every applicable gate has a named owner, a recorded status, visible or documentary verification, and a clear next handoff. If any required inspection is unknown, any membrane or protection layer cannot be identified, any drain route is unverified, or an open defect has no corrective action and recheck, the correct status is PAUSE, not “probably fine.” The record helps the people who can decide; it does not make the decision for them.
The timing matters because backfill changes the evidence available to everyone. Once soil covers the outside of the wall, a later reviewer may not be able to see a membrane termination, repaired tie hole, penetration seal, protection board joint, footing-drain connection, discharge route or damage caused while material was placed. Building Science Corporation describes foundation bulk-water control as a system involving surface water, groundwater, drainage layers and footing drains; it also notes that correcting a failed system later can be disruptive, destructive to landscaping and expensive. Its foundation report is useful for deciding what to preserve in the record, but it is not a site-specific approval.
The release record should answer six questions in order:
- What local gate applies? Identify the AHJ, permit, approved inspection list, required foundation or waterproofing inspection, hold point, required notice and any condition that must be cleared before backfill. Do not replace a missing local answer with a generic internet checklist.
- What was designed? Identify the plan sheet, detail, revision and any approved change that governs wall, footing, drainage, waterproofing, insulation, protection and backfill.
- What was installed? Name each product and layer, identify where it was installed, and record the trade or person responsible for the work.
- What can still be verified? Capture safe, location-labeled photographs and documents while the assembly is exposed. Ask the responsible trade to verify product-specific details and any measurements that require a professional.
- What is unresolved? List defects, unknowns, conflicts and conditions that could damage the assembly or alter the design intent. Assign an owner, corrective action and verification method.
- Who accepts the next handoff? Name the person releasing backfill, the person operating equipment, the person monitoring the wall and drainage layers, and the person receiving the completed record.
This sequence separates evidence from authority. The homeowner may preserve a photograph of an exposed corner; the waterproofing trade decides whether a membrane defect is repaired correctly; the builder coordinates the sequence; the AHJ decides whether its inspection or permit condition is satisfied; and an engineer or geotechnical professional decides questions within that professional scope. A homeowner’s confidence is not one of those authorities.
What “complete enough” means
“Complete” does not mean every possible field is filled with a yes. It means the project has identified which fields apply, which person verified them, what evidence supports the status, and what happens next. For example, a slab-on-grade foundation may not have an occupied basement wall, while a crawlspace may have different drainage and access details. A membrane manufacturer may require a protection layer; another assembly may use a different system. A local permit may require a foundation inspection but not use the same name as a neighboring jurisdiction.
Use four statuses:

Do not convert a pause to a release because the excavator is already on site, rain is approaching, the schedule is tight or the inspection was “probably done.” A delay is a project-management cost; burying an unknown can turn the same question into an excavation, repair and warranty dispute.
The homeowner’s safe role
The safe homeowner role is observation from a stable location, document control, questions and escalation. Do not enter an unprotected excavation, walk on a narrow footing ledge, climb over shoring, stand below suspended loads, approach operating equipment for a photograph, handle uncured chemicals or direct a worker from inside the excavation. OSHA’s excavation standard requires employee protection from cave-ins in covered excavations, with limited exceptions for stable rock or shallow excavations found safe by a competent person. The federal protective-systems standard is a worker-safety boundary, not permission for a homeowner to enter.
OSHA also describes a competent person as someone able to identify existing and predictable hazards and authorized to take prompt corrective measures. OSHA’s competent-person guidance makes that role more than a title: it connects hazard recognition with authority to act. Ask the builder who holds that role for this excavation and how the homeowner can observe without entering. Do not assume that the person who applied waterproofing, operates the excavator or owns the project is automatically the OSHA competent person.
The same boundary applies to photographs. Take wide images from the approved viewing area, use the builder’s safe access route if one exists, and ask the site supervisor to capture close-ups. Do not ask a worker to bypass protection, remove a barrier or stand in an unsafe position to improve the image. A photograph that creates a hazard is not useful evidence.
Identify the actual authority, permit and hold point before asking whether the foundation is ready #
The first documentation task is to identify the actual authority having jurisdiction and its project-specific gate; national guidance cannot tell a homeowner which local inspection, notice, adopted code, permit condition or approval is required at a particular address. Put the jurisdiction’s name, department, permit number, permit revision, contact route, required inspection name and clearance record at the top of the release record before backfill is scheduled.
Build the local-rule input, do not guess it
The words “foundation inspection,” “waterproofing inspection,” “drain tile inspection,” “under-slab inspection,” “footing inspection” and “backfill approval” can mean different things in different jurisdictions. Some authorities publish a stage list; some attach conditions to the permit; some require a request before a visit; some use an electronic inspection result; some distinguish a foundation wall from footing or drainage work. Those are local facts. Since no project jurisdiction is supplied here, the article cannot name a local rule without inventing one.
Ask the builder or permit holder to provide the authoritative local source and record it. The source might be the AHJ’s permit portal, an issued permit condition, a plan-review comment, an inspection card or a written response from the department. Record:
- AHJ name and jurisdictional boundary: city, county, state, tribal authority, special district or other actual authority, as applicable;
- project address and permit number;
- adopted code edition named by that authority, if the authority identifies one;
- approved plan set, plan-review comments and foundation detail revision;
- inspection names, order, notice method and whether each is a hold point before backfill;
- inspection request date, result, inspector or record identifier when lawfully available;
- conditions, corrections or reinspection requirements;
- the builder’s interpretation of what remains open; and
- the exact next contact if the local rule is unclear.
Do not write “code approved” when the record only says “builder says okay.” Use the precise status: “inspection requested,” “inspection passed,” “correction issued,” “AHJ confirmation pending,” “permit condition not located,” or “not applicable per [named source or decision-maker].” The wording matters later when someone asks what was known before the soil was placed.
Distinguish four different kinds of clearance
An AHJ inspection, a builder release, a trade completion notice and an engineering decision are different events. They may occur in one meeting, but one should not be silently substituted for another.

The release record should have separate lines for each applicable clearance. A builder can coordinate an AHJ visit without being able to issue the AHJ’s result. A waterproofing installer can identify its membrane without deciding whether a structural crack is acceptable. A homeowner can preserve the evidence without issuing any of those decisions.
What to do when the local answer is unavailable
If the permit portal is offline, the inspection name is ambiguous, a plan note conflicts with a field instruction, or the builder says an inspection is unnecessary without a source, mark the local gate PAUSE — jurisdictional requirement unresolved. Give the builder the address, permit number, plan sheet, planned backfill date and exact question. Ask the builder or permit holder to obtain a written or recorded answer from the AHJ.
If the AHJ says a step is not required, record who said so, when, through what channel, and the scope of that answer. “No inspection needed” is incomplete unless the record identifies the authority and the work covered. If the answer applies only to a footing and not to waterproofing, drainage or backfill, preserve that limit.
Do not ask an online adviser to interpret an unprovided local code. Do not ask for a remote sign-off based on photographs. Remote documentation can support a later conversation, but the actual authority and responsible professionals decide whether a local gate, technical correction or site condition is resolved.
Record the foundation, penetrations and waterproofing while every important surface is visible #
Document the exposed foundation as a location-labeled visual and written record, then have the responsible trade verify defects, repairs, coverage and measurements before protection and soil conceal the work. A photo set is most useful when it can later answer where a condition was, which detail governed it, who checked it and what changed after the image was taken.
Start with orientation, not close-ups
Use a consistent location system before taking photographs. The simplest system is the approved plan’s orientation plus elevations or grid references: “north wall, west corner, 4 feet east of corner,” “south wall, penetration P-03,” or “interior face at stair opening.” If the plan has no useful grid, create a sketch that identifies the street side, corners, steps, offsets and major penetrations. Ask the builder to confirm the orientation.
For each image, record:
- date and local time;
- wall or foundation location;
- view direction and a reference object or scale where safe;
- layer shown, such as concrete, repair, membrane, board, drain, cleanout or discharge;
- related plan/detail sheet and revision;
- product or work package, if known;
- photographer and the person who verified the image;
- weather or site condition that could matter to cure or visibility; and
- whether the image is a general orientation view, a detail, a defect, a repair or a final condition.
Take an orientation photo of each wall, then overlapping medium views, then detail images. The overlap allows a future reviewer to locate a detail without guessing. Use a ruler, tape or marked card only when it can be placed safely by the responsible trade; do not lean into the excavation or touch a membrane to create a scale. If the trade already uses a wet-mil gauge, thickness log or manufacturer form, request a copy rather than attempting a homeowner measurement.
Inspect the concrete surface by question, not by appearance alone
The homeowner can ask whether the visible wall matches the approved detail and whether known defects were addressed. The homeowner cannot decide from a photograph whether a crack, honeycomb, tie hole, cold joint, offset, exposed reinforcement, form-tie remnant or penetration is structurally or waterproofing-acceptable.
Use a location list:

Applied Technologies’ Hydra-Guard WB instructions illustrate why the record must include product identity and preparation, not just “waterproofed.” For that named product, the instructions call for a dry, clean substrate free of standing water, loose material, frost, ice, snow, fins, wires and projections that could interrupt or damage a continuous membrane. They also address tie holes, voids, honeycombs and penetrations before application. The manufacturer’s current application instructions apply to Hydra-Guard WB; they do not establish a universal rule for another membrane.
Ask the waterproofing trade to record preparation exceptions and repairs. A phrase such as “wall cleaned” is less useful than “north wall, P-03 sleeve: loose mortar removed; repair material: [name]; installed [date/time]; cured per [current instruction]; rechecked by [person].” If the product data sheet requires an application temperature, substrate condition, wet thickness, cure interval or inspection method, copy the exact current instruction into the project record or attach it with its revision date.
Record waterproofing as a product-specific assembly
Do not use “waterproofing” as if it names one thing. The record should identify manufacturer, product, membrane type, product-data or application-instruction revision, installer, application date, approximate weather conditions and every layer intended to protect or drain it. If the product is unknown, stop before backfill and ask the builder to identify it from delivery records, submittals, labels, invoices or the installer’s daily report.
For a liquid-applied membrane, ask how the installer verified coverage or thickness. Applied Technologies’ Hydra-Guard WB instructions specify a 60-mil wet thickness and direct the installer to inspect the membrane before backfill for pinholes, blisters and voids, with reapplication to deficient areas as instructed. The same product instruction should be the source for the trade’s product-specific record. A homeowner can record that a wet-mil gauge reading was reported; the homeowner should not claim to have independently measured an inaccessible wall.
For a sheet membrane or another liquid system, the record may instead need seam overlaps, primer, adhesive, fastener pattern, termination bar, corner treatment, substrate moisture, protection and cure conditions. Those fields come from the selected product’s current instructions and the approved detail. Do not import the Hydra-Guard 60-mil number into another product.
For repairs, use a before-and-after sequence. The first image shows the defect and location; the repair record names the material and method; the next image shows the repaired condition; the trade states whether another cure or inspection is required. If the repair changes the approved detail, escalate it to the builder and the authority or professional whose decision is required. A patch hidden by protection board is not self-verifying.
Check what a photograph cannot prove
Photographs can show that a board appears present, that a membrane appears continuous in a visible area, or that a drain outlet is visible at one moment. They cannot prove a concealed seam is bonded, a membrane has reached a required cured state, a drain has a continuous fall, a buried pipe is undamaged, a foundation is structurally adequate, or an AHJ would approve the work.
Write the limit into the record. Examples:
- “Photo shows protection board at north wall; trade to verify full coverage and attachment against current instructions.”
- “Photo shows outlet at daylight point; builder to verify continuity and permitted discharge route.”
- “Photo shows no visible pinholes from this viewing position; waterproofing trade to complete its inspection before release.”
- “Photo shows repaired tie hole; repair material and cure verification pending.”
This wording protects the reader from a common documentation failure: turning an observation into a technical conclusion. The record is stronger when it says exactly what it can and cannot establish.
Verify drainage and protection as connected layers, not as separate checklist boxes #
Before backfill, verify the planned water path from the wall and soil-side layers to the footing drain and lawful discharge or sump arrangement, and verify that the protection layer is the correct product for the selected membrane. A drain board or protection course is not proof of a functioning drain, and a waterproof membrane is not proof that water pressure has been managed.
Building Science Corporation explains that water accumulation against a foundation wall or below a slab creates hydrostatic head pressure that can push water through joints, imperfections or cracks. Its report identifies free-draining backfill or drainage board, a functional footing drain directed to daylight or a sump, and drainage below the slab as parts of the control strategy. The report is general building-science guidance; the site’s approved details, soil conditions, local requirements and qualified professionals control the project.
Trace the planned water path
Start at the foundation wall. Identify the wall-side membrane or dampproofing, then the drainage or protection layer, then the gravel or other specified drainage zone, then the footing drain, then the cleanout, daylight outlet, storm connection or sump. The actual assembly may differ, and the correct record follows the approved detail rather than this generic order.

Building Science Corporation specifically describes a footing drain as a low-point element that carries collected water to daylight or a sump pit. It also describes coarse gravel and filter fabric around the drain as measures that help limit sediment clogging. The report’s footing-drain discussion does not authorize a particular discharge connection. Record the actual outlet and the person who verified it, then confirm any discharge or stormwater rule with the actual jurisdiction.
Do not perform a homeowner “flow test” by flooding an excavation, disconnecting a sump, pouring water into a drain or standing near an open outlet. If the builder proposes a test, record the proposed method and ask the responsible professional whether it is appropriate for the installed system and current conditions. The record should preserve the result reported by the person conducting the test, not convert an improvised experiment into an approval.
Treat protection-board compatibility as a question requiring two documents
Protection products are not interchangeable accessories. The selected membrane manufacturer and the protection-course manufacturer must both be checked for compatibility, timing, attachment, coverage, environmental exposure and backfill handling. Keep the actual product data sheets and current application instructions with the release record.
Tremco describes EnForce as a drainage and protection layer for Tremco waterproofing membranes and says it must be used with an effective, adequately functioning foundation drainage system. Tremco’s EnForce application instructions are product-specific. They should not be used to approve EnForce over an unlisted membrane or to claim that the site drain works merely because the board is installed.
The same Tremco instructions say the board is set as the membrane begins to cure, that timing varies with conditions, and that the membrane must be fully cured before backfill. They state a minimum 24-hour interval after membrane and board application, while warning that weather may require longer. Use the current Tremco instruction when recording the actual timing. Record membrane application time, board application time, weather, any observed delay and the responsible trade’s release statement.
The instructions also specify mechanical attachment with washers and a standard spacing of no more than 12 inches, with additional fasteners in harsh or heavy-clay conditions, and limit unpackaged UV exposure to 14 days during installation. Those numbers belong to the EnForce instruction, not every protection board. Photograph representative attachment, corners, top and bottom transitions, and any unusual condition from a safe location. Ask the installer to verify full coverage and the current product requirements.
Insulfoam describes its Insulfoam DB as an EPS drainage board with channels every 2 inches on center, intended for exterior foundation applications to reduce hydrostatic pressure from adjacent backfill and protect underlying damp-proofing or waterproofing. Insulfoam’s DB product page supports that description for the named product. It does not establish that the board is suitable for your membrane, wall height, soil, climate, code or approved detail. Record the product and ask the builder or waterproofing trade to identify the compatibility basis.
W. R. Meadows gives a similar but separate warning for its Protection Course: consult the waterproofing manufacturer to determine whether the facing is compatible with the specific membrane. It describes a continuous protective layer and directs users to follow the membrane manufacturer’s precautions. Review the Protection Course application guidance if that named product is used. “Compatible with most” on a product page is not a site-specific approval; the actual membrane, facing, adhesive and detail still need to be matched.
Record protection timing and backfill behavior
The time between application and backfill is not just a calendar field. It is a relationship among product cure, weather, substrate, protection installation, inspection, exposure and placement method. Record the actual times and conditions rather than writing “waited a day.” If the instruction says “fully cured,” ask the installer what verification they use and whether conditions extended the interval.
W. R. Meadows says a vertical protection course for a wall receiving backfill should be butt-jointed and held as needed, and warns that backfill should not be dropped in a way that drags the sheet down or damages the waterproofing. Its backfill-handling instruction is for that product and should be read with the membrane manufacturer’s instructions. Record the planned drop height, equipment position, material path and who watches the wall if the builder has specified them. The homeowner should not direct equipment or enter the excavation to monitor the operation.
A good release record includes a “do not infer” line: “Protection board present does not prove membrane cure, full coverage, compatibility, drain continuity or AHJ clearance.” That sentence prevents a visual layer from being treated as a complete system.
Protect the record from a product substitution
A common handoff failure is a substitution that sounds equivalent: “drainage mat,” “protection board,” “waterproofing,” “coating” or “filter fabric” appears in a text message without a manufacturer, model, thickness, revision or approved change. Ask for the submittal, delivery ticket, label, product data sheet and installation instruction for what is actually on the wall. Compare the product to the approved plan and note whether the builder, designer, AHJ or manufacturer representative must approve the substitution.
Never backfill to meet a truck or crew deadline while a product identity question remains open. The cost of waiting for a document is usually visible and bounded. The cost of excavating after concealment includes access, soil handling, landscaping, damage risk and a new coordination problem. Building Science Corporation’s report makes the same construction-stage point in broader terms: it is generally more practical to specify and execute bulk-water-control details during construction than to retrofit a failed foundation system later. Assign each record to the person who can verify or correct it #
The release record should name a responsible person for every decision, not merely list trades or companies. The builder coordinates the handoff, but responsibility for a technical fact belongs with the person who performed or is qualified to verify that fact, while local approval belongs with the AHJ. A homeowner should never be left as the default verifier because the homeowner is the person who asked for photographs.

The exact names vary by project. “Waterproofer” may be an employee, subcontractor or specialist; “builder” may be a general contractor, owner-builder or construction manager; the permit holder may not be the person operating the excavator. Put people’s names, roles, phone or email, and date of acceptance in the record. A company name alone is not enough to establish who received an open item.
Make responsibility specific enough to survive a dispute
Weak entry: “Builder checked drainage.”
Stronger entry: “Jordan Lee, site superintendent for [builder], verified from the approved foundation detail D-4.2 that the footing drain outlet at the southeast corner is the planned daylight point; outlet photo set 2026-09-07-SE-01 through 04 attached; discharge-permission question remains open with [actual AHJ], so status is PAUSE.”
Weak entry: “Waterproofing done.”
Stronger entry: “Avery Smith, [waterproofing company], recorded [manufacturer/product], application date/time, preparation exceptions, reported thickness method, repair locations and cure/release condition; builder to confirm required inspection before board/backfill; status is CORRECT until repair recheck is attached.”
The stronger entries do not claim more than the evidence supports. They distinguish a trade’s report from a homeowner’s observation and a builder’s coordination from an AHJ result.
Manage handoffs in the right order
Use this handoff sequence unless the approved plan or local process requires a different one:
- Builder to homeowner: provide the current plan/detail, permit information and planned backfill window.
- Builder to AHJ: request any required inspection or confirmation through the jurisdiction’s actual process.
- Foundation trade to builder: identify concrete conditions, repairs and penetrations requiring treatment.
- Waterproofing trade to builder: provide product identity, installation conditions, repairs, cure and protection requirements.
- Drainage/excavation trade to builder: identify footing-drain route, outlet or sump connection and backfill material/placement plan.

The homeowner should ask to be copied on the final record, but copying is not acceptance. If the builder refuses to identify who is responsible for an open item, write “responsible person not named” and escalate within the contract’s communication path. Apply a gating rule, not a false score
You may use a completion percentage to find missing paperwork, but never use it as an engineering or inspection pass. Define:
Record completeness (%) = verified applicable fields ÷ total applicable fields × 100
Illustrative modeled example: suppose this project identifies 18 applicable fields: one AHJ/permit gate, one plan detail, three installed products, one cure/weather record, one compatibility record, two footing-drain records, one outlet record, one photo-location set, two backfill-plan fields, one responsible person per release, one open-defect field, one corrective-action field, one verification field and one final handoff field. If 16 are verified, then:
16 ÷ 18 × 100 = 88.9%
That percentage can tell the homeowner where to ask questions. It cannot authorize backfill. If the two missing fields are a required AHJ hold point and a membrane cure verification, the status remains PAUSE even though 88.9% sounds high. If the two missing fields are genuinely not applicable and the builder records why, remove them from the denominator and recalculate:
16 ÷ 16 × 100 = 100%
The sensitivity is the point: changing applicability changes the denominator, so the number is only an administrative completeness aid. A single gating field can control the decision. Never average away a missing safety, legal, product or technical gate.
Use the failure branches
Branch A — Required local inspection is unknown. Mark PAUSE. Give the permit number and planned backfill date to the builder or permit holder. Ask the actual AHJ whether the inspection or hold point applies and preserve the answer. Do not call a generic inspection result a local approval.
Branch B — Inspection was requested, but the result is missing. Mark PAUSE. Ask for the official result, correction list and whether a reinspection is required. If an inspector visited but the record is not posted, preserve the date and inspector/contact information and have the permit holder resolve the record through the AHJ.
Branch C — Builder says the work passed, but the plan revision is unclear. Mark ESCALATE. Compare the field condition to the approved revision and ask the builder and designer or engineer whether the later revision governs. If the change affects the permit, ask the permit holder to resolve it with the AHJ.
Branch D — Membrane product is unidentified. Mark PAUSE. Ask the waterproofing trade for the label, product data sheet, delivery record and current application instructions. Do not use a different manufacturer’s cure or thickness number as a substitute.
Branch E — Membrane has visible pinholes, blisters, voids, open seams or damaged areas. Mark CORRECT. Photograph the location from safety, notify the builder and waterproofing trade, record the repair material and method, wait for the required cure or reinspection, and capture the recheck before protection and backfill.
Branch F — Protection board is present but compatibility is unverified. Mark PAUSE. Identify both membrane and protection products, check both manufacturers’ instructions and obtain the builder/trade decision or approved change. A product description that says “compatible with most” is not the missing project-specific match.
Branch G — Drain board is present but footing-drain continuity or outlet is unknown. Mark PAUSE. Ask the drainage/foundation trade to trace the route and identify the outlet or sump. Preserve the approved detail and confirm any discharge condition with the actual jurisdiction. Do not flood-test or enter the excavation yourself.
Branch H — Weather or cure conditions changed. Mark PAUSE until the responsible trade verifies the current product’s cure condition. Record rain, frost, standing water, low temperature, direct exposure or delay if relevant to the instruction. Do not treat elapsed calendar time as proof of cure.
Branch I — Backfill equipment or material could contact the wall. Mark CORRECT the placement plan before the first load. Close the record only with a next handoff
A release record is not complete when someone writes “okay.” It is complete when the next action is assigned and the record is transferred. For RELEASE, the builder records the AHJ result or local status, trade verifications, planned sequence, responsible backfill supervisor and recipient of the final record. At the release meeting, read back the unresolved list. Ask:
- What evidence is still missing?
- Who can decide it?
- Does it change the approved detail, permit or product sequence?
- What is the safest action while the answer is pending?
- What document or observation will close the item?
- Who receives the updated record after closure?
If the answer to any of these is “we will figure it out after backfill,” the record is not ready for release unless the builder and applicable decision-maker explicitly confirm that the item is not a pre-backfill gate and document why.
Preserve the completed record for handoff, maintenance and future questions #
After backfill, preserve the final record with the permit, approved plans, inspection results, product instructions, photographs, repairs, drainage route and warranty documents; note what is now concealed and what future maintenance or access depends on it. The most useful record is not the largest photo folder. It is a navigable chain from the local requirement and design detail to the installed layer, release decision, final handoff and later ownership question.
Assemble the final package
Use a stable folder or project-management location with a simple naming convention. Keep originals and do not overwrite a correction photo with a new image. A workable structure is:
